By downloading or using TouchTalk Pro ("the App"), you agree to be bound by Apple's standard End User License Agreement (EULA), available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/, and to the supplemental terms in this document.
TouchTalk Pro is an AAC (Augmentative and Alternative Communication) app for iPhone that enables users to communicate using customizable symbol-based boards, text-to-speech synthesis, custom photos, and custom audio recordings. The App operates entirely on-device with no internet connection required.
Subject to your compliance with these Terms and Apple's EULA, Ingeniería.dev grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App on any iPhone that you own or control, for your personal, non-commercial purposes.
You may not: (a) copy, modify, or create derivative works of the App; (b) reverse-engineer, decompile, or disassemble the App; (c) rent, lease, or sublicense the App; or (d) use the App for any unlawful purpose.
TouchTalk Pro is offered free of charge. There are no In-App Purchases, no subscription plans, and no premium tiers. All features available in the App are accessible to all users at no cost.
Ingeniería.dev reserves the right to introduce optional features or purchases in future versions. Any such features will be clearly disclosed before any charge is incurred, and existing free functionality will not be removed or locked behind a paywall without advance notice.
You may create vocabulary boards, add photos, and record audio messages within the App. You retain full ownership of all content you create. Ingeniería.dev does not access, transmit, or store your content on any server. All content is stored locally on your device and is your responsibility to back up.
You agree not to create or store content within the App that is illegal, defamatory, or infringes the rights of others.
The App may include symbol sets or images licensed from third parties. Such symbols are licensed for personal, non-commercial AAC use only. You may not extract, redistribute, or use those symbols outside the App.
TouchTalk Pro is a personal communication aid, not a medical device. It does not diagnose, treat, monitor, or assess any medical condition, including but not limited to autism spectrum disorder, apraxia of speech, amyotrophic lateral sclerosis (ALS), aphasia, cerebral palsy, or Down syndrome.
The App is not cleared or approved by any regulatory authority (including the U.S. Food and Drug Administration, the European CE marking authority, or COFEPRIS in Mexico) as a medical device or as a clinical assessment tool.
TouchTalk Pro is designed to support personal communication and may be used alongside therapy provided by licensed speech-language pathologists or other qualified healthcare professionals. It is not a substitute for professional medical evaluation, diagnosis, or treatment. Always seek the advice of a qualified healthcare provider with questions about a medical condition.
The App and its original content, features, and functionality are owned by Ingeniería.dev and are protected by applicable copyright, trademark, and other intellectual property laws. The name "TouchTalk Pro" and any associated logos are trademarks of Ingeniería.dev.
Your use of the App is also governed by our Privacy Policy. The App collects no personal data and makes no network requests.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. INGENIERÍA.DEV DOES NOT WARRANT THAT THE APP WILL BE ERROR-FREE OR UNINTERRUPTED.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, INGENIERÍA.DEV AND ITS DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA OR LOSS OF COMMUNICATION ABILITY, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP. IN NO EVENT SHALL OUR LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE APP (WHICH IS ZERO).
You agree to defend, indemnify, and hold harmless Ingeniería.dev and its developer from any claims, damages, obligations, losses, liabilities, costs, or expenses arising from your use of the App in violation of these Terms.
You acknowledge that Apple Inc. is a third-party beneficiary of these Terms and Apple's EULA, and that Apple has the right to enforce these Terms against you as a third-party beneficiary.
You represent that you are not located in a country that is subject to a U.S. government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. government list of prohibited or restricted parties.
These Terms are effective until terminated. Your rights terminate automatically if you fail to comply with any provision. Upon termination, you must cease all use of the App and destroy all copies.
These Terms are governed by the laws of Mexico City, Mexico, without regard to conflict of law principles. Any dispute shall be submitted to the competent courts of Mexico City, Mexico.
