1. Parties

This agreement is entered into between you (the end user) and Ingeniería.dev, operated by Chris Flores, with its registered address at Av. Javier Barros Sierra 495, Santa Fe Lomas de Santa Fe Zedec Santa Fé, Álvaro Obregón 01219, Mexico City, CDMX, Mexico. Contact: christian@irack.mx.

2. App description

Tomly is an iOS application that helps you remember when to take your medications. You add each medication and its schedule, and the App fires local notifications at the configured times. The App also records, locally on your device, when you mark a dose as taken, skipped, or snoozed, so you can review your adherence history. Tomly is designed for personal use; it is a wellness reminder tool and not a medical device.

3. License

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use Tomly on iOS devices you own or control, subject to these Terms and to Apple's Standard EULA.

Tomly is free. The App contains no In-App Purchases, no subscriptions, no advertising, and no paid content. There is nothing to buy, nothing to cancel, and nothing to restore. Every feature is unlocked from the first launch — unlimited medications, every schedule type, full adherence history, and any future improvements that ship inside the App.

If a future version ever introduces paid features, this section will be updated and any new business model will be opt-in. As of the date above, Tomly is and remains free.

5. Accounts and authentication

Tomly does not require you to create an account or sign up. There is no email, no password, no username. The App does not authenticate against any server because it does not communicate with one. Your device is the only place that knows about your medications.

6. Reminder reliability and medical disclaimer

Important — read carefully Tomly is a wellness reminder tool, not a medical device. It is not intended to diagnose, treat, cure, or prevent any disease. The App does not replace medical advice, prescriptions, or supervision. Always follow your healthcare provider's instructions.

Tomly schedules iOS local notifications to remind you of your doses. While iOS is generally reliable, notifications can be delayed, missed, or suppressed by system conditions outside our control, including:

For medications where missing a dose can cause serious harm (insulin, anticoagulants, anti-rejection drugs, controlled-release neurological treatments, etc.), do not rely on Tomly as your only reminder. Use a redundant system (a physical pill organizer, a second alarm, a family member, a clinical reminder service) and consult your healthcare provider about safe medication management.

The Developer is not a healthcare provider, pharmacist, or medical institution and provides no medical advice through the App.

7. User data

See our Privacy Policy. In short: all your data — medications, schedules, adherence history — lives on your device; we do not collect or transmit personal information of any kind. No PHI ever leaves your iPhone.

8. Intellectual property

Tomly, its code, design, interface, text, and brand are the property of Ingeniería.dev and are protected by Mexican and international intellectual property laws. These Terms do not transfer any ownership to you — only a license to use the App.

9. Disclaimer of warranties

The App is provided "AS IS" and "AS AVAILABLE", without any express or implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee uninterrupted, error-free, or perfectly timely operation of reminders. We do not warrant the App for any medical, clinical, or safety-critical use.

10. Limitation of liability

To the maximum extent permitted by applicable law, the Developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, nor for personal injury, missed doses, adverse health outcomes, financial losses, or any harm arising from your use of or inability to use the App. Because the App is provided free of charge, the Developer's aggregate liability for any claim shall not exceed USD $50.

11. Indemnification

You agree to indemnify and hold the Developer harmless from any claims arising from: (a) your improper use of the App, (b) your violation of these Terms, (c) your reliance on the App for safety-critical medication management without independent backup, or (d) your violation of third-party rights.

12. Termination

We may suspend or terminate your license if you breach these Terms. You may terminate this license at any time by uninstalling the App.

13. Changes to the Terms

We may update these Terms from time to time. The current version will always be published at this URL, along with the date of the update. Continued use of the App after an update constitutes your acceptance. Material changes will also be announced inside the App.

14. Relationship with Apple

Apple Inc. is not a party to this agreement and is not responsible for the App or its content. In the event of a conflict between these Terms and Apple's Standard EULA, the terms more restrictive and applicable to Apple under the App Store Review Guidelines shall prevail.

15. Governing law and jurisdiction

These Terms are governed by the laws of the United Mexican States. Any dispute shall be submitted to the competent courts of Mexico City, and both parties expressly waive any other jurisdiction that might otherwise apply based on current or future domicile.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
